Use of the GoMove™ Website

Scottish Rite for Children gladly provides free access to its GoMove website for the benefit of parents and their children with unilateral cerebral palsy, though subject to the following conditions and all applicable laws. As a condition to your accessing and using the Scottish Rite for Children GoMove website, you signify your informed acceptance of Scottish Rite for Children’s Legal Disclaimer (as it may be amended from time to time) and your agreement to follow the terms and conditions that are stated in this Legal Disclaimer. This Legal Disclaimer is a legally binding contract regarding your use of the GoMove website. Please check back periodically for any Legal Disclaimer updates.

The GoMove website is managed in the State of Texas, United States of America, and Scottish Rite for Children does not make any representation that it is doing business in all geographic areas or any foreign country or jurisdiction. You are responsible for compliance with all applicable local laws and regulations if you access the GoMove website from other locations.

Privacy

GoMove provides to information on goal setting and examples of exercises and activities that can be incorporated into daily routines at home for these children. The GoMove website allows you to input information about your child’s goals and progress toward reaching those goals aimed at improving your child’s upper limb function. However, we do not collect, nor do we intend for you to input, personally identifying information into the GoMove website. Other than as expressly set forth below, the GoMove website does not knowingly process personal information of users. Scottish Rite for Children may collect and use non-personal information such as aggregate data or usage information in its discretion, but in so doing it will not combine such data with personal information of users.

The information you enter into the GoMove website is stored in a secure database and not shared with others, except for third-party service providers that host the GoMove website. When you register for an account, you are provided with a randomly generated, unique code (“Code”) that you will need to keep. Upon your return to the GoMove website, if you do not remember that Code, you will need to re-register for a new Code, because we do not have anyway of associating a Code with a specific user. If you want to track your information over time, you will have to use the same Code.

The only possible identifier associated with your use of the GoMove website is a “session only” computer cookie. A computer cookie is a piece of data that a website may transmit to your browser for various purposes, including identification. The GoMove website uses “session only” cookies to track the use of the website but the cookie is not permanent and it does not retain your personal information. A “session cookie” is deleted once you close your web browser.

Personal Information From Children ( the “COPPA Clause”)

We do not knowingly collect, disclose, or use personally identifiable information or market to children Therefore, in accordance with the U.S. Children’s Online Privacy Protection Act of 1998 (“COPPA”), we do not knowingly request or solicit personally identifiable information from anyone under the age of 13 without prior verifiable parental request. If we receive actual knowledge that we’ve collected such personal information without the requisite and verifiable parental consent, we will delete that information from our database as quickly as is reasonably practical.

Medical Information Disclaimer

The information found on the GoMove website is not intended to be, nor is it, medical advice on the management or care of unilateral cerebral palsy or any other medical condition. The information provided is also not intended to act as a substitute for an examination, diagnosis and/or medical care provided by a certified and skilled health care professional. Use of this website does not establish a doctor-patient relationship. Any information you enter into the GoMove website is not monitored by any healthcare provider.

Our mission is to provide free access to information on goal setting and selection of exercises and activities that can be incorporated into daily routines at home aimed to improve upper limb function for children with unilateral cerebral palsy. Although Scottish Rite for Children endeavors to keep the GoMove website current, health care information changes rapidly and thus the website should not be relied upon as fully comprehensive or error-free. Scottish Rite for Children does not advocate attempting to treat yourself, your child or someone you know without proper medical supervision. Always consult with a doctor, healthcare provider, or other medical professional before making any medical decisions.

Viruses (Malware)

There is always a possibility of computer viruses (malware) on the Internet. Although Scottish Rite for Children uses commercially reasonable efforts to prevent the transmission of any viruses/malware to or from the GoMove website, placing your system online can expose you to outside attack. You release Scottish Rite for Children from all responsibility or liability for viruses/malware. Scottish Rite for Children assumes no responsibility and cannot be held liable for any damages to, or viruses/malware that may infect, your computer equipment or other property on account of your access to, use of or browsing of the GoMove website, or your downloading of materials, data, texts, images, video or audio from the site.

Warranties & Liability

WE PROVIDE ACCESS TO THE GOMOVE WEBSITE “AS IS” AND WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT AND NONINFRINGEMENT.

Any trademarks and service marks referenced in the GoMove website are the trademarks and service marks of their respective owners unless they are expressly marked as being owned by Scottish Rite for Children. Any references that Scottish Rite for Children may make on the GoMove website to any names, marks, products or services of third parties, or to hypertext links to third-party sites, or to third-party information, are not meant to constitute or imply Scottish Rite for Children’s endorsement, sponsorship or recommendation of the third party, information, product or services. Governing Law

You agree that your use of the GoMove website and this Legal Disclaimer is governed by the laws of the State of Texas and that proper and convenient venue lies exclusively with the state or federal courts of Dallas County, Texas. You agree that the statute of limitations for any claim against Scottish Rite for Children shall be brought within one year from when the claim arose, and any claims not brought within such period of time shall be deemed waived.

Reservation

Scottish Rite for Children reserves the right to amend the terms and conditions of this Legal Disclaimer at any time without prior notice. When Scottish Rite for Children amends this Legal Disclaimer, the new version will be added to the GoMove website and apply from the “Posted Date” for such terms. You agree that your use of the GoMove website constitutes acceptance of all of the terms and conditions as they may be amended in the future.
